Development of a Draft on making amendments to Federal Law No. 98-FZ of 01.04.2020 on regulation of lease relations

Due to the pandemic announced, the lawyers of the firm worked out amendments to Federal Law No. 98-FZ of 01.04.2020 on the right of tenants to terminate the lease agreement. The original wording of the amendments was changed by the legislator to address the interests of property owners; however, the scheme of the proposed rules became the basis for the text of Clause 4 of Article 19 of Federal Law No. 98-FZ of 01.04.2020 (revised on 30.12.2020) "On Amendments to Certain Legislative Acts of the Russian Federation Regarding Prevention and Liquidation of Emergency Situations". The new rules made it possible for the tenants to terminate lease agreements and give up premises that could not be used due to the sanitary measures taken, or to substantially cut down the rent for such premises.
