Court or Government Agency: Who and When Can Fine Companies
An unscheduled inspection of the Magnit retail chain by the Federal Service on Customers' Rights Protection and Human Well-Being Surveillance (Rospotrebnadzor) erupted into problems for one of the chain’s oil suppliers. The supervisory authority found that the goods had been incorrectly declared, and fined the company. The firm appealed this fine to the court.
In practice, it is not always possible to find out whether a supervisory authority could have imposed any fines on the company in a particular situation or not
Lower courts decided that only court could impose administrative liability on the companies. The Supreme Court decided otherwise. And Pravo.ru experts advised businessmen on when and why they should challenge the fines imposed by administrative bodies. Mikhail Abrosimov, the firm’s counsel, is quoted as commenting.
